2 April For Debt No Jail Charge Finished

2008 Assistant Deputy Coroner Scott Baker finishes his summing up to the inquest jury investigating the circumstances of deaths of Diana Princess of Wales and Dodi Fayyad including giving directions that disallowed a verdict the crash was staged because there was not enough evidence for any trier of fact to be satisfied so that it was sure and allowed the jury to consider if it was more likely than not that aspect of the theory such as the flash before the crash and the manner of driving of  a Fiat Uno ahead of the Mercedes. He also said  the Jury had to be satisfied so it was sure of each element of unlawful killing by gross negligence which are there was duty of care owed by the vehicles involved There was a breach this breach was a substantial contributing factor the breach was worthy of sanction and the breach was so great as to be deserve the condemnation of gross negligence manslaughter meaning that it was close to malice aforethought required for murder. If it failed on any of these elements it could not find the verdict and would then consider if it was more than likely the crash was an accident. If they failed this they would find an open verdict which implies the deaths were a result of foul play. So any attempt to blame the coroner for covering up a crash by denying a verdict of a staged crash shows a lack of understanding of the law since open verdict is like a not guilty verdict in that it is given because there is not enough evidence to find any other verdict.
